The Family and Medical Leave Act (FMLA) provides eligible employees unpaid, job-protected leave for serious health conditions. Please read the information below carefully before contacting us.
What is FMLA?
The Family and Medical Leave Act (FMLA) is a federal law that allows eligible employees to take up to 12 weeks of unpaid, job-protected leave per year for serious health conditions, including psychiatric conditions. Leave may be taken continuously, intermittently, or as a reduced schedule depending on medical need.
EKM Psychiatry does not determine whether a patient qualifies for FMLA leave. Our role is limited to completing the medical certification portion of the form based on your treatment and medical record at this practice. Submission of paperwork does not guarantee approval of leave by your employer.
FMLA certification requires active treatment participation and adequate clinical documentation. Initial certifications generally cover the period supported by current clinical findings. Recertifications are evaluated individually and require updated clinical assessment.
Who qualifies?
EKM Psychiatry may complete FMLA certification when all of the following conditions are met:
You must
- Be actively engaged in treatment at this practice
- Be attending scheduled appointments as recommended
- Be participating in medication management, when indicated
- Have your diagnosis and functional limitations documented in your record
- Be current on all outstanding account balances
- Submit your request with adequate time before any deadline
We cannot
- Determine FMLA eligibility or guarantee leave approval
- Certify limitations not supported by the medical record
- Complete forms without adequate clinical documentation
- Guarantee completion by deadlines submitted on short notice
- Certify leave retroactively without clinical support
- Exaggerate symptoms or functional impairment
We can certify
